Biznevo Terms of Service

1. The Services

Biznevo is an AI platform that researches your business and generates marketing and content deliverables (such as websites, social posts, emails, presentations, and campaigns) by orchestrating third-party AI models and managed, automated AI work sessions, and, where you connect accounts and approve, publishes content on your behalf.

The Services are currently in an early-access stage. Features may change, be interrupted, or be discontinued.

2. Eligibility and Accounts

You must be at least 18 years old and using the Services on behalf of a business. You are responsible for the accuracy of information you provide and for safeguarding your account credentials.

3. AI-Generated Content — Your Responsibility to Review

The Services use artificial intelligence. AI-generated content can contain errors, inaccuracies, or material that requires editing.

• By default, deliverables land in your approval queue and publishing requires your explicit approval.
• You may optionally enable auto-publish for reversible actions (such as social posts, emails, and texts), globally or per channel. Actions that are irreversible, financial, or legally binding — spending money, signing contracts, accepting terms, making purchases — ALWAYS require your explicit approval, even with auto-publish enabled. Biznevo never spends your money, signs for you, or accepts terms on your behalf.
• You are solely responsible for content you approve, publish, or use (including content published under an auto-publish setting you enabled), including its accuracy, legality, and compliance with advertising rules and platform policies applicable to your business.
• Biznevo does not provide legal, financial, medical, or other professional advice.

4. Your Content and Ownership

• Your inputs: You retain all rights to the business information, brand assets, and files you provide. You grant us a license to use them solely to provide the Services to you.
• Generated outputs: As between you and Biznevo, you own the deliverables generated for you through the Services, subject to the rights of third parties and the terms of the underlying AI model providers.
• Our platform: Biznevo retains all rights to the Services, including our software, orchestration engine, and learning systems. Aggregated, de-identified learnings that contain no customer-identifiable data may be used to improve the Services for all customers.

5. Acceptable Use

You agree not to:

• Use the Services to create or distribute content that is unlawful, deceptive, infringing, or harmful;
• Attempt to access another customer's data or probe, scan, or test the vulnerability of the Services without written authorization;
• Resell or white-label the Services without a written agreement;
• Use the Services to violate any platform's terms (e.g., spam, fake engagement, scraping);
• Circumvent usage limits, rate limits, or cost controls.

We may suspend or terminate access for violations.

6. Third-Party Services and Integrations

The Services orchestrate third-party AI models (including Anthropic, OpenAI, Google, Perplexity, Replicate, and Higgsfield) and connect to third-party platforms via official APIs and OAuth. Your use of connected platforms remains subject to those platforms' own terms. We are not responsible for third-party services, their availability, or changes to their APIs or policies.

Where the Services involve advertising spend on a connected platform, that spend runs through your own payment method on that platform — Biznevo never holds or custodies your advertising funds.

7. Fees and Payment

Pricing, billing terms, and usage allowances for paid plans will be presented at purchase. Plans include a monthly usage allowance measured in tokens; usage beyond your allowance may be billed as overage or require an upgrade, as described in your plan. Unless stated otherwise: fees are charged in advance, usage-based limits apply as described in your plan, and fees are non-refundable except where required by law. We may change pricing with 30 days' notice.

Payments are processed by Stripe; Biznevo does not store your card details.

8. Beta and Demo Features

Demo and beta features are provided "as is," may be rate-limited, and may produce sample-quality output. Do not submit confidential information through the public demo.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT GENERATED CONTENT WILL BE ACCURATE, ERROR-FREE, OR ACHIEVE ANY PARTICULAR BUSINESS RESULT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIZNEVO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $100.

11. Indemnification

You will indemnify and hold Biznevo harmless from claims arising out of content you approve or publish, your business operations, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Services and request account deletion at any time (see biznevo.com/data-deletion). We may suspend or terminate the Services for breach, legal risk, or discontinuation, with notice where practicable. Sections 4, 9, 10, 11, and 13 survive termination.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, and each party consents to their jurisdiction.

14. Changes to These Terms

We may update these Terms. We will post updates with a new effective date and notify registered users of material changes. Continued use after changes take effect constitutes acceptance.
